Apple sells 4 million iPhone 4S in 3 days

The company took more than 1 million online orders in the first 24 hours after the release of the iPhone 4S, exceeding the 600,000 for the iPhone 4, though it was sold in fewer countries.Unveiled just a day before Apple Chairman Steve Jobs died, it was initially dubbed a disappointment, partly because it looked identical to its predecessor. But anticipation of its “Siri” voice software helped it set an online record in orders on October 7.Along with the new iPhone, more than 25 million customers are using the iOS 5 mobile operating system, in the first five days of its release, and more than 20 million customers have signed up for its free cloud services, Apple said.The latest iPhone will be available in 22 more countries on October 28 and more than 70 countries by the end of the year.

UPDATE 1-Court upholds Reyes options backdating conviction

Oct 13 (Reuters) - Former Brocade Communications Systems Inc Chief Executive Gregory Reyes failed to convince a U.S. appeals court to overturn his criminal conviction related to stock option backdating.The 9th U.S. Circuit Court of Appeals on Thursday rejected Reyes’ appeal, saying he failed to establish that prosecutors erred during the second of two trials for backdating.Prosecutors said that Reyes engaged in illegal option backdating to reward insiders and mislead investors, and to pad his own pocket from the scheme.Backdating means retroactively pricing option grants on days a company’s stock price was low, to lock in financial gains. The practice in effect increases the value of the options, but is not illegal if properly accounted for.Reyes was convicted in 2007 on multiple counts including securities fraud. That verdict was overturned by the 9th Circuit, which cited prosecutorial misconduct.Reyes was retried last year and again convicted on a series of counts. He was sentenced to 18 months in prison and a $15 million fine.Stephen Neal, an attorney for Reyes, said in an email on Thursday that he was deeply disappointed by the 9th Circuit ruling.A U.S. Department of Justice spokesman declined to comment.The case in the 9th Circuit is United States of America v. Gregory Reyes, 10-10323.

Gold touches day’s lows after U.S. jobs data

The dollar extended gains versus the euro , knocking dollar-priced commodities such as gold and crude oil , after the U.S. Labor Department said initial claims for state unemployment benefits dipped 1,000 to a seasonally adjusted 404,000, the Labor Department said, from an upwardly revised 405,000 the prior week.
